KD Trainer Personal Training Terms & Conditions
1. Payment Terms
1.1. Services provided by KD Trainer will commence only upon receipt of full payment for the agreed-upon training package or session, unless an authorised instalment plan has been agreed upon in writing.
1.2. Failure to provide full payment before the commencement date will result in the delay or cancellation of training services until payment is received.
1.3. Where instalment payments are permitted, failure to pay any instalment on its due date will immediately suspend all booking privileges and accelerate the remaining contract balance, rendering it immediately due and payable.
1.4. All training packages carry a strict 365-day ( 1 year) expiration period from the date of purchase. Unused sessions beyond the validity period will automatically lapse and are non-refundable and non-transferable, except at KD Trainer’s sole discretion.
1.5 A package may be frozen once per agreement for a maximum period of 30 days upon written notice, provided valid justification (such as overseas work travel or certified medical temporary unfit notice) is submitted.
2. Cancellation Policy
2.1. Clients must provide a minimum of 24 hours notice to cancel or reschedule a training session.
2.2. In the event of a cancellation made less than 24 hours before the scheduled appointment, KD Trainer reserves the right to apply a last-minute cancellation. The session will be deducted from the client’s account or charged separately.
2.3. KD Trainer may, at its sole discretion, waive the last-minute cancellation fee in exceptional circumstances, such as sudden illness or emergencies. Clients must provide appropriate documentation or evidence to support such requests.
2.4. KD Trainer reserves the right to refuse future bookings or terminate services for clients who repeatedly cancel sessions without adequate notice.
3. Rescheduling Policy
3.1. Clients may request to reschedule a training session within the same week as the originally scheduled appointment, provided that 24 hours notice is given.
3.2. If a client is not available to reschedule within the same week due to being out of town or other valid reasons, KD Trainer may accommodate rescheduling requests for a later date, subject to trainer availability.
3.3. KD Trainer reserves the right to limit the number of rescheduling requests allowed per client to ensure the efficient management of training schedules.
4. Trainer Allocation & Punctuality
4.1. Contracts are executed between the client and KD Trainer Pg Sdn Bhd, not an individual coach. KD Trainer reserves the right to assign, substitute, or reassign qualified coaches for any session to ensure training continuity without altering the terms of this agreement.
4.2. If a client arrives late, the session will conclude at the originally scheduled finishing time to preserve subsequent bookings. No make-up time will be granted.
5. Health Screening, Physical Indemnity & Safety
5.1. Execution of a Physical Activity Readiness Questionnaire (PAR-Q) and signing of KD Trainer’s Liability Waiver and Indemnity Form is a mandatory condition precedent to commencing any exercise program.
5.2. The client warrants that all health information provided is complete and accurate. The client bears an ongoing obligation to notify KD Trainer immediately of any new injuries, illnesses, pain, or changes in medical condition before beginning any workout.
5.3. KD Trainer reserves the right to terminate any exercise session immediately if a client appears intoxicated, physically distressed, or acts in a manner that compromises their safety or the safety of others.
6. Facility Rules & Code of Conduct
6.1. KD Trainer reserves the right to terminate client agreements immediately without refund in cases of abusive behaviour, harassment toward staff or other clients, non-compliance with safety instructions, or willful damage to facility equipment.
6.2. KD Trainer assumes no responsibility for the loss, theft, or damage of personal property brought onto the premises.
7. Governing Law & Dispute Resolution
7.1. These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
7.2. The parties irrevocably submit to the exclusive jurisdiction of the Courts of Malaysia in respect of any dispute or claim arising out of or in connection with these terms.
The KD Trainer Client Commitment
KD Trainer is committed to providing high-quality personal training services. In the event that a client is dissatisfied with the services provided, they may be eligible for a refund subject to the terms outlined below.
1. Refund Policy
1.1. Refunds will be provided for the remaining unused sessions in the client’s training package, calculated based on the original purchase price excluding tax (8% SST) minus a 5% transaction fee.
1.2. To request a refund, clients must submit a written refund request to KD Trainer, specifying the reasons for dissatisfaction and providing any relevant documentation or evidence to support their claim. KD Trainer will review refund requests, and refunds will be processed within 7 days of approval.
2. Late Trainer Policy
In the event that a KD Trainer is late for a scheduled training session, the following compensation will be provided to the client:
2.1. Free Session: The delayed session will be provided to the client at no cost.
2.2. Additional Session: Additionally, one extra session will be added to the client’s training program as compensation for the inconvenience caused by the delay.
By signing the Registration Form or electronically accepting these terms and conditions, I hereby acknowledge that I have read, understood, and agree to abide by the terms and conditions outlined herein.
KD Trainer GymSchool Terms & Conditions
1. Contracting Parties & Parental Authority
1.1. All enrollments are entered into by the parent or legally appointed guardian (“Parent/Guardian”) on behalf of the enrolled minor student (“Student”). The Parent/Guardian warrants that they hold the full legal capacity and parental authority to bind the Student to these terms.
1.2. To maintain our coaching standards and student safety, class sizes operate on a strict maximum 1:6 coach-to-student ratio.
2. Billing Cycles & Auto-Renewal
2.1. Billing Cycle: All memberships operate on a recurring 4-week (28-day) billing cycle, processed automatically by our third-party payment processing partner, HitPay.
2.2. Automatic Renewal: Memberships automatically renew every 4 weeks unless a formal cancellation or pause request is submitted at least seven (7) calendar days prior to your next billing date.
2.3. Payment & Booking Access: Active payment via HitPay allows session booking privileges inside our scheduling platform (Rezerv). If a recurring payment fails or is paused, class booking privileges inside Rezerv will be temporarily locked until account status is updated.
3. Attendance, Booking & Expiration Policy
3.1. Expiration (No Rollover): All sessions allocated for a 4-week cycle must be utilised within that specific 4-week billing period. Unused sessions expire at the end of the billing cycle and cannot be carried forward to future cycles.
3.2. Slot Reservation Guarantee: Your active membership reserves a dedicated space for your child in our class under our strict 1:6 coaching standard. Because that slot is reserved exclusively for your child regardless of attendance, unused sessions are non-refundable and non-transferable.
3.3. Class Bookings: Parents/Guardians are required to pre-book their child’s weekly slots via the Rezerv platform. Bookings can only be made up to the active membership cycle end date.
4. Cancellation, Rescheduling & Make-Up Classes
4.1. Cancellation Window: If your child is unable to attend a booked class, you must cancel or reschedule the class via Rezerv at least 6 hours in advance.
4.2. Late Cancellations & No-Shows: Cancellations made within less than 6 hours of class start time, or unannounced non-attendance, will result in forfeiture of that session.
4.3. Medical & Emergency Exceptions: Exceptions (such as sudden medical illness) require a medical certificate (MC) submitted via WhatsApp to our team within 48 hours for a makeup pass to be manually issued within the active 4-week cycle.
5. Membership Pauses & Holds
5.1. Pause Eligibility: Memberships may be paused for extended travel or medical reasons for a minimum of one (1) week and a maximum of two (2) weeks per billing cycle.
5.2. Advance Notice: A written request must be submitted via WhatsApp/Email at least 7 days before your next HitPay billing renewal date. Retroactive pause requests will not be processed.
5.3. During a Pause: Auto-renewals on HitPay will be temporarily held, and Rezerv booking access will be paused until the agreed resume date.
6. Refund Policy
6.1. All membership fees, trial fees, and registration packs processed via HitPay or any other payment methods are strictly non–refundable.
6.2. In the event KD Trainer cancels a class due to facility issues, weather, or coach lateness/unavailability, an additional makeup credit will be credited to the student’s Rezerv profile.
6.3. KD GymSchool Progress Guarantee. To qualify for guarantee:
(a) The Student must maintain 100% attendance (attending all scheduled sessions within a consecutive 4-week cycle without cancellations or no-shows);
(b) Progress is measured against KD Trainer’s standard youth physical literacy and movement competency assessment metrics completed at baseline;
(c) Complimentary coaching shall be provided in standard group classes for a maximum of 4 additional weeks or until core competency benchmarks are met.
7. Code of Conduct & Safety
7.1. Punctuality: Parents/guardians must ensure students arrive 5–10 minutes before class start time. Late arrivals will not be compensated and will still be taken as attendance.
7.2. Pickup Standard: Parents are encouraged to be present at the entrance at class completion for the coach’s post-class update and child pick-up. KD Trainer accepts no custodial duty of care or premises liability for Students left unattended beyond ten (10) minutes post-class.
7.3. Student Code of Conduct: KD Trainer reserves the right to suspend or remove any Student whose disruptive, violent, or unsafe behaviour compromises the safety and learning environment of other children, with no refund issued for unutilized sessions.
8. Medical Disclosure, Physical Readiness & Media Consent
8.1. Medical Readiness: The Parent/Guardian warrants that a Health Screening form has been accurately completed. The Parent/Guardian has a continuing obligation to immediately report any new injuries, chronic conditions, or health developments affecting the Student.
8.2. Photography & Media Consent (PDPA Compliance): KD Trainer may capture photographs or short video clips of classes for internal coaching review and marketing purposes. Parents/Guardians who wish to opt out must declare as such during the registration process in the Registration form or submit a formal written request via email/WhatsApp prior to the child’s first class.
